1. Terminology
→ Client, commissioner, you. Individual who requests, uses and pays for the services of another person.
→ Artist, seller, angeleyesXO, Rotten, me. Person who exchanges goods and services to another in return for payment.
→ Commission, artwork, work, art, product, piece, material. All artistic production (sketches, drawings, illustrations, paintings, WIPs, etc). requested, agreed upon and paid for by the client to the seller.
→ Non-commercial license.
1. “Non-Commercial License is a legal agreement that permits use of a product, service, or intellectual property only for personal or educational purposes, not for commercial gain” (TermsFeed)
2. “This Work has been digitized in a public-private partnership. As part of this partnership, the partners have agreed to limit commercial uses of this digital representation of the Work by third parties. You can, without permission, copy, modify, distribute, display, or perform the Item, for non-commercial uses [...]” (Rights Statement)
2. Payment methods, estimated completion times & refund policy
2.1. Payment
→ Payments are only accepted through Paypal Invoices. Note that you do not need a PayPal account to pay, as the invoice sent to your email has multiple methods to choose from, including Venmo, debit or credit card. This may vary from region to region.
→ A price breakdown will be written within our communication channel, plus any additions if applicable, before the invoice is sent.
→ Payments can be scheduled in two ways: 1. 100% Upfront payment.
2. 50% Upfront, 50% at the end. The second payment must be sent after the client’s approval of the finished product. If not, no files will be sent to the client’s e-mail until the money has been received.→ In both of the aforementioned methods, I will not begin the commission unless payment is received first, which should be completed in a span of 48 hours. You can request for an extension if necessary, however, if the invoice is not eventually paid, the contract will be broken and the commission cancelled.
2.2. Estimated Completion Date
→ An art commission can take between 1 to 2 months, depending on the workload, health issues and external factors. Any delays will be communicated.
→ Please be aware that I do not work with deadlines.
2.3. Refunds & Cancellations
Refunds will be given under 2 concrete circumstances: 1. Where I, as the artist, am not able to finish the work as a result of persistent and/or intense health-related issues, personal issues, family matters or any other event of sheer-magnitude. The percentage returned will be considered on a case-by-case basis with the client.
2. Where you, the client, wishes to cancel the commission before the main stage of each commission type. In the case of B&W pieces, it’d be before the inking; in the case of color pieces, it’d be before coloring begins. No cancellations will be accepted after the fact. The percentage returned will be based on the progress of the work done so far. The rights of the materials produced will fall exclusively onto the artist and can be used at their own discretion.
→ No refunds or cancellations after the work has been finished.
→ In the case a client breaks one or multiple terms of this contract, the relationship will be terminated and refunds will be considered at the artist’s discretion. The seller reserves the right to deny a refund request.
3. Details
3.1. Image size
→ The size of the image (traditional or digital) typically is, at minimum, ISO 216 standard A4 size (8.27x11.69 inch or 2480x3508 pixels). Size may increase depending on the project needs, however, this metric does not influence the pricing of the commission.
3.2. Changes
→ 6 changes are allowed in total. Further changes outside of the aforementioned will cost extra.
→ For traditional commissions, please keep in mind that, due to the nature of the medium I’m working with, changes are almost impossible to do in the inking phase. Keep major changes to the sketching and polishing stages.
→ Digital commissions are not bound to the previous rule.
3.3. References
→ When reaching out for a commission, attach text descriptions, photos, drawings, character sheets and any other helpful resources to serve as reference for the art.
→ If your character has many particular details, please be sure to point them out from the beginning so I’m able to keep track of them during the process.
→ Please let me know if there’s a specific detail in a piece of mine that you’d like to see replicated in yours and I’ll do the best to make it to your liking.
4. Delivery
Upon completion of the artwork, the client will be notified and receive the following files to their e-mail:1. One high-quality PNG without the artist’s signature. This encompasses:
→ 300 DPI full size image.
2. Two JPEG files without the artist's signature, best-fitted for web sharing because of their compressed size and reduced quality. These encompass:
→ 300 DPI full size image
→ 72 DPI half size image→ The finished work will be sent as digital files, regardless of the medium in which they were created. Due to personal inexperience, potential legal ramifications and differing country policies, angeleyesXO does not feel comfortable shipping traditional artwork to its clients; therefore, you should not expect the arrival of any physical goods.
→ The commissioner can request which email address the files should be sent to or if they wish to use another service to receive them (ex.: WeTransfer).
5. Copyright policy
→ Commissions are for personal, non-commercial use only. → You, the client, retain the right to: share said work on social media and messaging services; use it as a profile picture, avatar or header; use it as reference material for other commissions and for personal printing.
→ I, the artist, retain the rights to all work produced. This includes, but is not limited to: WIPs (works in progress), sketches, unedited illustrations, final illustrations, etc.
→ With the exception of private commissions, I reserve the right to post and share the art for promotion purposes on social media, as part of my portfolio or as an example of my capabilities to other clients.
→ Credit isn’t necessary but appreciated, as long as you do not pass the art as yours, nor use it to impersonate and deceive others.
→ I do not consent my art, whether it’s a WIP or the final product, being fed or trained to generative AI models, used in NFTs, the blockchain, or any cryptocurrency related activities.
